ACCEPTABLE USE POLICY
E Digital Solution
Effective Date: May 10, 2026
1. GENERAL OBLIGATIONS
By using the services provided by E Digital Solution (including domain hosting, website design, and graphic design services), you agree to comply with this Acceptable Use Policy (AUP) and all applicable laws and regulations. You are responsible for ensuring that your use of our services does not violate any third-party rights, including intellectual property, privacy, or contractual rights.
E Digital Solution reserves the right to investigate any suspected violations of this policy and take appropriate action, including service suspension or termination, if you breach any provision herein.
2. ACCEPTABLE RESOURCE USAGE
To ensure fair access and quality service for all customers, E Digital Solution enforces the following resource usage limits:
Shared Hosting Accounts:
- Multimedia storage: 10GB maximum
- Email storage per mailbox: 20GB maximum
- Database storage: 10GB maximum
- Concurrent database connections: 100 maximum
- Monthly data transfer: Unlimited (fair use applies)
- CPU usage: Limited to prevent impact on other users
Reseller Accounts:
- Reseller resource allocation: 400GB maximum
- Reseller customers must comply with all provisions of this AUP
Customers approaching or exceeding these limits will be notified and given reasonable time to reduce usage. Continued violation may result in service degradation, suspension, or termination.
E Digital Solution monitors resource utilization to ensure compliance and maintain service quality for all clients.
3. SHARED HOSTING USAGE
If you maintain a shared hosting account with E Digital Solution, you must not:
- Use an excessive percentage of server resources (CPU, memory, processes) that negatively impacts other users
- Run applications or services that consume disproportionate server resources
- Engage in practices that degrade server performance or stability
- Execute automated scripts or bots that strain server infrastructure
- Store files intended solely for backup or archival purposes (use backup services instead)
- Host applications designed for large-scale data processing or heavy computation
E Digital Solution reserves the right to suspend services if your account consistently exceeds fair usage thresholds. We will provide written notice and a reasonable opportunity to remedy the violation before suspension.
4. EMAIL USAGE
E Digital Solution operates a zero-tolerance spam policy. You must not use email services provided by E Digital Solution to:
- Send unsolicited commercial email (spam) to any recipient
- Engage in phishing, spoofing, or email fraud
- Distribute malware, viruses, or any harmful code via email
- Send emails impersonating other individuals or entities
- Use email services for mass mailing that violates anti-spam laws
- Send bulk email to purchased or harvested email lists without explicit consent from recipients
All email sent through E Digital Solution services must comply with the CAN-SPAM Act (US), GDPR (EU), and other applicable anti-spam legislation.
Violations of this email policy will result in immediate service suspension and termination without refund. E Digital Solution does not provide email hosting for marketing purposes unless explicitly agreed in writing.
5. RESELLER ACCOUNTS
Resellers offering E Digital Solution services to end customers must:
- Ensure all resold customers comply with this AUP
- Assume liability for resold customer violations
- Monitor reseller resource allocation (400GB maximum) and ensure fair distribution
- Require end customers to register valid contact information
- Maintain reseller account security with strong authentication
- Immediately notify E Digital Solution of any customer violations
For Regulated Industries: If reseller accounts are used for customers in regulated industries (financial services, healthcare, legal services), resellers must provide E Digital Solution with:
- Proof of industry licensing or registration
- Documentation of compliance with relevant regulations (GDPR, HIPAA, PCI-DSS, etc.)
- Written verification that services are authorized for regulated use
E Digital Solution retains the right to request additional documentation or deny reseller status if regulations are not met.
6. PROHIBITED ACTIVITIES
The following activities are strictly prohibited on E Digital Solution services:
Illegal Activities:
- Hosting or distributing content that is illegal in Portugal or the European Union
- Facilitating fraud, hacking, or unauthorized access to systems
- Distributing ransomware, malware, or other malicious code
- Operating services related to piracy or copyright infringement
Abusive Content:
- Adult content, unless explicitly authorized in writing
- Content that harasses, defames, or threatens individuals
- Hate speech or discriminatory content
- Content that violates intellectual property rights
Security Violations:
- Port scanning, vulnerability testing, or penetration testing without authorization
- Distributed Denial-of-Service (DDoS) attacks
- SQL injection, cross-site scripting, or other web application attacks
- Brute force attacks against any system
Unethical Practices:
- Click fraud, ad fraud, or deceptive marketing
- Multi-level marketing schemes or pyramid schemes
- Cryptocurrency mining (mining activity is strictly prohibited)
- Operating proxy services or anonymizers for illegal purposes
E Digital Solution monitors for violations using automated and manual review processes. Detected violations will result in immediate investigation and service suspension.
7. MONITORING AND COMPLIANCE
E Digital Solution reserves the right to:
- Monitor resource usage, server logs, and customer behavior to enforce this AUP
- Review file storage to detect violations of this policy
- Scan for malware, viruses, and security threats
- Investigate complaints of abuse or violations
File Visibility: E Digital Solution support staff may access customer files if:
- Required for security investigations
- Needed to diagnose technical problems
- Responding to legal requests or law enforcement
- Addressing reported violations of this AUP
Customers are notified of access unless legally prohibited. E Digital Solution commits to maintaining reasonable privacy standards while protecting all customers’ security and service quality.
8. NOTIFICATION AND RESOLUTION
Violation Notice: When E Digital Solution detects a potential violation, we will:
- Send written notice to the customer’s registered email address
- Describe the specific violation and evidence
- Provide 5-10 business days to remedy the violation (severity dependent)
- Explain the consequences of continued violation
Customer Response: Upon receiving notice, customers may:
- Remedy the violation within the specified timeframe
- Request clarification or dispute the violation
- Appeal the determination to E Digital Solution management
Enforcement Actions:
- First offense: Written warning and opportunity to remedy
- Repeated violations: Service suspension
- Severe or illegal violations: Immediate termination without refund
- Email spam violations: Immediate termination
E Digital Solution will not restore suspended services until violations are remedied and the customer provides written confirmation of compliance.
9. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless E Digital Solution, its owners, employees, and agents from any claims, damages, liabilities, or costs (including legal fees) arising from:
- Your violation of this AUP or applicable laws
- Your use of E Digital Solution services in violation of third-party rights
- Content you host or distribute through our services
- Actions or omissions by you or users you authorize
- Damage to E Digital Solution infrastructure or other customers caused by your account
This indemnification applies regardless of whether E Digital Solution had prior knowledge of potential liability.
10. REVISION POLICY
E Digital Solution reserves the right to modify this Acceptable Use Policy at any time. Changes will be:
- Posted on the E Digital Solution website (www.edigitalsolution.pt)
- Effective immediately upon posting unless otherwise stated
- Communicated via email to active customers when material changes occur
Continued use of E Digital Solution services after policy modifications constitutes acceptance of the updated AUP. Customers who disagree with material changes may request service termination within 30 days of notification.
