General Terms

General Acceptable Use Policy

Your Agreement With Us


E Digital Solution ("we", "us", "our", or "Company") provides digital solutions including domain hosting, website design, and graphic design services. These Terms and Conditions of Service ("Terms") govern your use of our services and your relationship with us.


2. Definitions and Interpretation

  • Services – All domain hosting, website design, graphic design, and related services provided by E Digital Solution
  • Client – The individual or organization purchasing Services
  • Agreement – These Terms and Conditions, together with any Service Schedule, invoice, or purchase order
  • Websitewww.edigitalsolution.pt and any associated platforms where Services are offered
  • Effective Date – The date Services commence or the date you accept these Terms
  • Support – Technical assistance and guidance related to your Services

3. Service-Specific Terms

3.1 Domain Hosting

  • Domain registration, renewal, and maintenance services as specified in your Service Schedule
  • DNS management, email forwarding, and domain transfer assistance (where applicable)
  • Uptime target: 99.5% annually, excluding scheduled maintenance
  • Responsibility for domain name content and legality rests with Client
  • Auto-renewal enabled by default; you may disable in your account settings

3.2 Website Design

  • Custom website design and development as outlined in your project agreement
  • Hosting and maintenance of your website during the service term
  • Technical support for website functionality and updates
  • Design revisions limited to the number specified in your Service Schedule
  • Content (text, images, materials) is your responsibility; you warrant you own or have rights to use all content

3.3 Graphic Design

  • Custom graphic design services including logos, marketing materials, and brand assets
  • Number of revision rounds and deliverables as specified in your project agreement
  • Files provided in requested formats (PNG, PDF, AI, etc.)
  • Design ownership transfers to Client upon final payment

4. Payment Terms

  • Pricing – Quoted in EUR or other currency as specified in your invoice
  • Payment Method – Bank transfer, credit card, or other methods accepted by the Company
  • Invoice Date – Payment due within 30 days of invoice date unless otherwise agreed
  • Late Payment – Interest accrues at 1.5% per month on overdue accounts
  • Refunds – See Section 6 (Money-Back Guarantee)
  • Taxes – Client responsible for applicable VAT or sales taxes in Portugal or your jurisdiction

5. Acceptable Use Policy

Client agrees not to use Services to:

  • Violate applicable laws, regulations, or third-party rights
  • Host illegal content or intellectual property you do not own
  • Transmit malware, spam, or harmful code
  • Engage in phishing, fraud, or harassment
  • Reverse-engineer, hack, or conduct unauthorized access
  • Resell Services without written permission
  • Create excessive server load or interfere with other clients' services

Violation of this policy may result in immediate suspension or termination without refund.


6. Money-Back Guarantee and Refunds

  • New Clients (First 14 Days) – Full refund if you cancel Services within 14 days of Service commencement, provided no substantial work has been completed
  • Website Design Projects – Non-refundable once design work has commenced; partial refund available if project is cancelled before 25% completion
  • Graphic Design Projects – Non-refundable once design work has commenced
  • Domain Registrations and Renewals – Non-refundable; domain registration is controlled by external registries
  • Hosting Services – Pro-rata refund available if cancelled before monthly billing cycle completes
  • Cancellation Request – Must be submitted in writing to support@edigitalsolution.pt

7. Intellectual Property Rights

  • Your Content – You retain all rights to content and materials you provide (text, images, logos, etc.)
  • Our Work Product – Design work, website code, and custom graphics are our intellectual property until final payment is received
  • License Grant – Upon final payment, we grant you a non-exclusive license to use the work product for your business purposes
  • Third-Party Materials – Certain design elements, templates, or libraries may be subject to third-party licenses; we provide them under permitted use conditions
  • DMCA Compliance – We comply with Digital Millennium Copyright Act (DMCA) takedown procedures

8. Data Protection and Privacy

  • GDPR Compliance – We comply with European General Data Protection Regulation (GDPR) and Portuguese data protection laws
  • Data Handling – Personal data processed only for Service delivery, billing, and legal compliance
  • Your Responsibility – You are responsible for obtaining user consent and providing privacy notices for any personal data collected through your website or services
  • Data Processing Agreement – Available upon request for enterprise clients
  • Breach Notification – We will notify you of any confirmed data breach within 72 hours of discovery

9. Liability Limitations

TO THE FULLEST EXTENT PERMITTED BY LAW:

  • Disclaimer of Indirect Damages – We are not liable for lost profits, lost revenue, loss of data, or indirect damages arising from your use of Services
  • Liability Cap – Our total liability shall not exceed the amount paid by Client in the 12 months preceding the claim
  • Exclusions – Liability limitations do not apply to: (a) death or personal injury caused by our negligence, (b) fraud or willful misconduct, (c) data breaches caused by our gross negligence
  • Service Interruption – We are not liable for data loss due to your failure to maintain backups or security practices

10. Service Suspension and Termination

10.1 Suspension

The Company may suspend Services immediately without notice if:

  • Client violates the Acceptable Use Policy
  • Client's account is 30+ days overdue
  • We reasonably believe Services are being used for illegal purposes
  • Required by law or legal process

10.2 Termination

Either party may terminate Services by providing 30 days written notice. Upon termination:

  • Client remains liable for fees through the notice period
  • We will provide your data and files in a standard format (where applicable)
  • We may delete all files and backups 30 days after termination

11. Service Level Agreement (SLA)

  • Uptime Commitment – 99.5% availability for hosting services, measured monthly
  • Scheduled Maintenance – Typically 2-4 hours monthly, scheduled outside peak business hours
  • Support Response Times – Critical issues (24h), Standard issues (48h), General inquiries (5 business days)
  • Exclusions – SLA does not cover outages caused by Client negligence, malware, or external internet issues

12. SUPPORT AND MAINTENANCE

E Digital Solution provides technical support and maintenance services to assist you with your contracted services. Support requests should be directed to support @edigitalsolution.pt.

Support response times are as follows:

  • Billing inquiries: within 48 hours
  • Technical issues affecting service availability: within 4 hours
  • General support requests: within 24 hours

For critical issues impacting your service, you may contact support@edigitalsolution.pt with "URGENT" in the subject line.

Scheduled maintenance is performed during low-traffic periods, typically between 02:00 and 06:00 CET on Sundays. During scheduled maintenance windows, services may be temporarily unavailable. Such downtime is excluded from SLA calculations.


13. Changes to Terms and Services

  • We may update these Terms with 30 days written notice
  • Continued use of Services after changes constitutes acceptance
  • Material changes to pricing require your explicit written consent
  • Significant service changes may allow termination without penalty
